Definition
Exception of a party's duty of confidentiality for information that was acquired independently by them from an unaffiliated third source
Example
Confidential Information shall not include information or matter that the Recipient can demonstrate by reasonable and tangible evidence to the Discloser's reasonable satisfaction wass acquired by the receiving party from third parties which, to the knowledge of receiving party, have not received such information in confidence from the delivering party or from other third parties;
